1. Acceptance of Terms

By booking any service with Clearly Window Cleaning, LLC (“we,” “us,” “our”), you (“Client,” “you”) agree to be bound by these Terms of Service. These terms apply to all services, including one-time jobs and recurring memberships.

 

2. Services Offered

We provide the following professional services:

  • Exterior Window Cleaning
  • Interior Window Cleaning
  • Track Detailing
  • Screen Cleaning
  • Screen Repair
  • Gutter Cleaning
  • Solar Panel Cleaning
  • Light Fixture Cleaning
  • Mirror Cleaning
  • Christmas Light Installation

All services are performed using industry-standard tools, deionized (DI) water where applicable, and safe, non-toxic cleaning solutions.

 

3. Pricing & Memberships

  • Pricing: All services are quoted individually based on property size, condition, and scope.
  • Membership Plans (Recurring Customers):
    • Monthly: $150 off each cleaning
    • Quarterly: $100 off each cleaning
    • Biannual: $50 off each cleaning
  • Early Termination Fee: If you cancel a membership before your second scheduled cleaning, you will be charged an early termination fee equal to the full discount received on your first cleaning. After the second cleaning, memberships may be canceled at any time without an early termination fee (late cancellation fees may still apply — see Section 10).
  • HERO Discount: Eligible customers receive:
    • $40 OFF each cleaning appointment
    • $75 OFF each Christmas Light Installation
  • Eligibility: Active-duty or retired military, law enforcement, firefighters, EMS, dispatchers, and verified volunteers. Proof of eligibility is required and must be verified before your appointment (instructions: here).

 

4. Payment Terms

  • Accepted Methods: Credit/debit card, ACH, cash (attended only), and personal/business checks (Idaho banks only, $500 max).
  • Cash & Checks: Only accepted when Client is present. Checks must match the exact amount due—no cash back or refunds for overpayment.
  • Unattended Appointments: If Client is not present, the card on file will be charged the full amount due.
  • Returned Checks: Subject to the maximum penalties under Idaho law, including:
    • Treble damages (up to $500 extra)
    • 12% annual interest
    • Court costs and attorney fees
    • ChexSystems reporting
    • Potential prosecution by the District Attorney

By tendering a check, you agree to these terms and Idaho Code § 28-42-101 et seq.

 

5. Booking & Deposit Policy

  • A $100 deposit is required at booking for all new clients.
  • The deposit is fully refundable if the appointment is canceled 48 hours or more before the scheduled start time.
  • Cancellations within 48 hours result in forfeiture of the $100 deposit.

 

6. Attended Appointments & Access Policy

  • Interior Services: Client must be present or provide access (e.g., key, code, or trusted contact).
  • If Client is unavailable within 15 minutes of arrival:
    • Appointment is considered a no-show.
    • We will clean only safely and legally accessible exterior windows (e.g., front, unlocked sides).
    • Client will be charged the full amount for all scheduled services (interior + exterior), regardless of access.
    • $100 deposit is applied; remainder charged to card on file.
    • Interior and inaccessible exterior work is forfeited.
    • A new appointment must be booked at full price to complete the job.
  • We do not: Climb fences, risk dog bites, or work in unsafe conditions.
  • Payment covers crew time, travel, and blocked schedule.

 

7. Pet Policy

For the safety of our team and your pets:

  • All animals must be secured in a separate room, safely crated, or restrained during service.
  • We are not liable for escapes, bites, or stress-related incidents.
  • Failure to secure pets may result in service termination and full charge.

 

8. Liability & Insurance

  • We carry general liability insurance and perform work with trained, background-checked technicians.
  • Pre-existing damage (e.g., cracked glass, loose tracks, rusted frames) is not our responsibility.
  • We are not liable for:
    • Damage to inaccessible areas
    • Acts of God (storms, hail, etc.)
    • Client-provided equipment or access issues
  • Client agrees to indemnify and hold us harmless from claims arising from property conditions or access issues.
  • Client is solely responsible for ensuring safe access, including removal of obstacles, securing pets, and disclosing hazards (e.g., loose ladders, fragile glass).

 

9. Guarantees & Limitations

  • 7-Day Rain Guarantee: If spots appear from rain within 7 days of service, notify us immediately via phone (208-508-1788) or email ([email protected]) and we will return to reclean free of charge (excludes dust, pollen, or sprinkler overspray).
  • No warranty on:
    • Etched or permanently damaged glass
    • Screens with pre-existing tears
    • Solar panels with coating defects
  • Satisfaction is guaranteed on workmanship—notify us by phone or email within 48 hours of service for a resolution..

 

10. Cancellation & Termination

  • Late Cancellations:
    • New clients: Forfeit the $100 deposit (see Section 5).
    • Recurring clients: Charged a $100 late cancellation fee to the card on file.
  • Early Termination Fee and Late Cancellation Fee are not mutually exclusive — if both apply to the same appointment, both will be charged.
  • Our Right to Cancel: We may cancel or reschedule due to weather, safety, or unforeseen issues with 24-hour notice when possible.
  • Membership Auto-Renewal: Plans renew automatically unless canceled in writing. Cancellation requests must be emailed to [email protected].

 

11. Dispute Resolution & Governing Law

  • These terms are governed by the laws of the State of Idaho.
  • Any disputes will be resolved through binding arbitration in Ada County, Idaho, under AAA rules, or in small claims court if applicable.
  • Each party is responsible for their own legal fees unless awarded by the arbitrator.

 

12. Force Majeure

We are not liable for delays or failures due to events beyond our control, including severe weather, natural disasters, or supply chain issues.

 

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

 

14. Changes to Terms

We reserve the right to update these terms. Clients will be notified via email or at booking. Continued use of services constitutes acceptance.

 

15. Entire Agreement

These Terms constitute the entire agreement between Client and Clearly Window Cleaning, LLC, superseding any prior agreements or understandings, whether written or oral.
